YAHOO ANNOUNCEMENTS ONLY GROUP newsletter list are INELIGIBLE. This Contest is governed
exclusively by the laws of the United States. If you are outside the
United States and enter this contest, you are subject to the laws of
the United States governing this contest.
1. How to Enter. Between 12:00 a.m.
Eastern Time ("ET") on
September 1, 2008 and
5:00 p.m. ET on November 30, 2008 (the "Contest Period"), you may log onto
www.monicaburns.com/ContactSubscribe.htm
to
enter the Anticipation Contest (the "Contest"). There is
only one (1) way
to enter the Contest, which is free:
(a) Register to receive Monica Burns'
Yahoo Announcements Only
newsletter group to automatically be entered into the Contest: You can
register online as follows: Simply visit Monica Burns (the
"Sponsor") at
www.monicaburns.com/ContactSubscribe.htm
or any Sponsor partner registration page
promoting the Contest during the Contest Period, and complete
all required information on the Yahoo form, then click the
"submit" button at the end of the form. Limit one (1) Contest
entry per household and/or email account holder, which means an
individual may hold only ONE subscription to
Monica's Yahoo Announcements Only Group. Multiple email memberships
in Monica's Yahoo Announcements Only Group constitutes an unfair
advantage over other members and all multiple entries will be
disqualified.
All entrants must have a valid email address.
No automated entry devices and/or programs permitted. All entries
become the sole and exclusive property of Sponsor and receipt of
entries will not be acknowledged or returned. Delivery of prize
requires a street address (no P.O. Boxes). Sponsor is not
responsible for lost, late, illegible, stolen, incomplete, invalid,
unintelligible, misdirected, technically corrupted or garbled
entries, which will be disqualified, or for problems of any kind
whether mechanical, human or electronic. Only fully completed
entries are eligible. Proof of submission will not be deemed to be
proof of receipt by Sponsor.
2. Eligibility. Participation open
only to participants who are 18 or older as of opening date
of the Contest, and who are subscribed to Monica Burns Yahoo
Announcements Only
newsletter group. Proof of age may be required. Void where prohibited,
taxed or restricted by law. All United States federal, state and
local laws and regulations apply.
3. Random Drawing/Odds. One Prize winner
will be selected in a random drawing from among all eligible entries
received during the Contest Period. Odds of winning depend on the
number of eligible entries received. Drawing will be conducted by
Sponsor on or about
November 30, 2008. By entering the Contest, you fully and
unconditionally agree to be bound by these official rules ("Official
Rules") and the decisions of the Sponsor, which will be final and
binding in all matters relating to the Contest.
4. Prizes.
The prize package is
a $25 Barnes and Noble gift card and a bottle of massage oil. Sponsor reserves right
to substitute prize of equal value. Winner is responsible for all shipping costs
and/or taxes for products
bought with gift certificates awarded to the winner. Sponsor
will only pay shipping costs of prizes shipped directly from
sponsor to winner within the United States continental borders.
Winners who do not reside in the United States are responsible
for all shipping costs, which are due to the Sponsor prior to
shipment of prize via PayPal.
Approximate retail value
(ARV) of the Prize is $50.
Prize is nontransferable, nonassignable, and no cash alternative
will be offered. No substitutions of prize, except that Sponsor may
substitute any portion of a prize with something of equal or greater
value, at Sponsor's sole discretion. Any portion of a prize not
accepted by the winner is forfeited.
5. Notification. Winners will be
notified by email on or about
November 30, 2008. If any winner or
his/her guest is considered a minor in his/her jurisdiction of
primary residence (a "minor"), the prize is forfeited. If any winner
cannot be contacted within five (5) calendar days of first
notification attempt, if any prize or prize notification is returned
as undeliverable, if any winner rejects the prize, or in the event
of noncompliance with these Official Rules, such prize will be
forfeited and Sponsor reserves the right (a.) not award the prize or
(b.) select an alternate winner from all remaining eligible entries.
Upon prize forfeiture, no compensation will be given. If any winner
is a minor, the prize will be forfeited.
6. Conditions. All federal, state and
local taxes are the sole responsibility of the winners.
Participation in this Contest and acceptance of prize constitutes
each winner's permission for Sponsor to use his/her name, address
(city and state), and/or any statements made by each winner
regarding the Contest or Sponsor for advertising and promotional
purposes without notice or additional compensation, except where
prohibited by law. By participating, winner agrees to release and
hold harmless Sponsor and Sponsor's advertising and promotion
agencies and their respective parent companies, subsidiaries,
affiliates, licensees, partners, licensees, representatives, agents,
successors, assigns, employees, officers and directors, from any and
all liability, for loss, harm, damage, injury, cost or expense
whatsoever including without limitation, property damage, personal
injury and/or death which may occur in connection with participation
in this Contest, or possession, acceptance and/or use or misuse of
prize or participation in any Contest-related activity and for any
claims based on publicity rights, defamation or invasion of privacy
and merchandise delivery. Sponsor is not responsible if any prize
cannot be awarded due to delays or interruptions due to acts of God,
acts of war, natural disasters, weather or acts of terrorism.
Entrants who do not comply with these Official Rules or attempt to
interfere with this Contest in any way will be disqualified. There
is no purchase or sales presentation required to participate. A
purchase does not increase your odds of winning.
7. Additional Terms. In case of dispute
as to the identity of any entrant, entry will be declared made by
the authorized account holder of the email address submitted at time
of entry. "Authorized Account Holder" is defined as the natural
person who is assigned an email address by an Internet access
provider, online service provider, or other organization (e.g.,
business, educational, institution, etc.) responsible for assigning
email addresses or the domain associated with the submitted email
address. Any potential winner may be requested to provide Sponsor
with proof that such winner is the authorized account holder of the
email address associated with the winning entry. Any other attempted
form of entry is prohibited; no automatic, programmed; robotic or
similar means of entry are permitted. Sponsor, its affiliates,
partners and promotion and advertising agencies are not responsible
for technical, hardware, software, telephone or other communications
malfunctions, errors or failures of any kind, lost or unavailable
network connections, web site, Internet, or ISP availability,
unauthorized human intervention, traffic congestion, incomplete or
inaccurate capture of entry information (regardless of cause) or
failed, incomplete, garbled, jumbled or delayed computer
transmissions which may limit one's ability to enter the Contest,
including any injury or damage to your or any other person's
computer relating to or resulting from participating in this Contest
or downloading any materials in this Contest. Sponsor reserves the
right, in its sole discretion, to cancel, terminate, modify, extend
or suspend this Contest should (in its sole discretion) virus, bugs,
non-authorized human intervention, fraud or other causes beyond its
control corrupt or affect the administration, security, fairness or
proper conduct of this Contest or for any other reason Sponsor deems
it necessary. In such case, Sponsor may, at its discretion, select
the winner from all eligible entries received unaffected by the
problem. Sponsor reserves the right, at its sole discretion, to
disqualify any individual it finds, in its sole discretion, to be
tampering with the entry process or the operation of this Contest or
web site. Sponsor may prohibit an entrant from participating in the
Contest or winning a prize if, in its sole discretion, it determines
that said entrant is attempting to undermine the legitimate
operation of this Contest by cheating, hacking, deception, or other
unfair playing practices (including the use of automated quick entry
programs) or intending to annoy, abuse, threaten or harass any other
entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE
ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST
MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN
ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM
THE PERPETRATOR TO THE FULLEST EXTENT PERMITTED BY LAW. THE
COMMONWEALTH OF VIRGINIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE
JURISDICTION OF ANY CONTROVERSIES REGARDING THIS CONTEST AND THE
LAWS OF THE COMMONWEALTH OF VIRGINIA SHALL GOVERN THIS CONTEST. EACH
ENTRANT WAIVES ANY AND ALL OBJECTIONS TO AND HEREBY SUBMITS TO THE
JURISDICTION AND VENUE OF THESE COURTS.
8. Use of Data. By participating in this
Contest, you hereby agree to Sponsor's collecting, storing and using
your email and mailing address for the sole purpose of promoting the
work of Monica Burns. Participant's postal and electronic contact
data is will not be sold to a third party.
9. List of Winners.
